We are proud to announce that the scientific article of Attorney at Law Dr. Sebastjan Kerčmar, a specialist in civil and commercial law, titled «Indemnity for a Commercial Agent», was published yesterday in the monograph Studia Iuridica Miscellanea MMXX. The monograph is a compilation of scientific works by professors, scientific coworkers and doctoral students from the Faculty of Law of the University of Maribor. The goal of the monograph is to present the scientific research activities of the latter and and current (partial or final) research findings. The contributions deal with diverse and numerous areas of law, but they all share in common the fact that they offer original scientific conclusions that may significantly contribute to the further development of legal doctrine in Slovenia and elsewhere.
The article of Dr. Sebastjan Kerčmar addresses the regulation of indemnity for a commercial agent in Slovenian legislation and highlights some issues associated with it. One of the key issues is the question of the compatibility of the provisions of the Obligations Code (OZ), which regulate the indemnity for a commercial agent, with the Agency Directive. In addition to the right to indemnity afforded to commercial agents by the provisions of the Obligations Code which implement the provisions of the Agency Directive regarding the indemnity, the Slovenian legislator has, whether intentionally or unintentionally, introduced two additional rights to indemnity, that give rise to numerous additional questions. Due to seemingly minor but certainly significant deviations, questions also arise regarding the right to indemnity according to the provisions of the Obligations Code implementing the provisions of the Agency Directive. The indemnity as regulated in the Agency Directive itself raises many questions and is the subject of numerous open cases before the Court of Justice of the European Union.
